Employment Standards
The Prince Edward Island Employment Standards Act and Regulations establishes the minimum terms and conditions of work for all employees on Prince Edward Island who are employed by provincially regulated employers and are not covered by a collective agreement. The Prince Edward Island Employment Standards Act and Regulations falls under the jurisdiction of the Minister of Communities, Cultural Affairs and Labour and is administered by the Employment Standards Board.
In January of 2006, the Minister of Community and Cultural Affairs appointed a three member employment Standards Review Panel to conduct a comprehensive review of the Prince Edward Island Employment Standards Act and Regulations and the Youth Employment Act and provide recommendations for changes to the legislation. In September 2006 the Review Panel produced a report recommending proposed changes to the Act entitled "Enhancing Standards in the Island Workplace".
Early in 2007, a group of concerned employers and industry representatives gathered to discuss the most appropriate and productive way to express concern to government. With the assistance of the Greater Charlottetown Area Chamber of Commerce, a group of employers and industry associations came together and formed an Employer Coalition.
On March 30, 2007, the then Minister of Community and Cultural Affairs, Minister Elmer MacFayden, met with the members of the Employer Coalition to hear the concerns that employers were expressing about the proposed changes to the Act. Minister MacFayden committed to not move forward with any changes to the legislation until such time as the Employer Coalition prepared a submission to government on the impact of the proposed changes to the Act.
Subsequent to the provincial election and the appointment of the new government and Minister of Communities, Cultural Affairs and Labour, representative members of the Employer Coalition met with Minister Carolyn Bertram on July 19, 2007. Minister Bertram agreed to receive the submission on the proposed changes to the Act from the Employer Coalition.
The Employer Coalition respectfully submitted this document as the summary of represented employer concerns on the proposed changes to the Act as recommended in the Review Panel Report.
